The Americans with Disabilities Act was signed into law in July of 1990 by President George H.W. Bush. This law, made it illegal for employers to discriminate against qualified job applicants and employees based on their physical or mental disabilities. The law also required employers to provide reasonable accommodations to applicants and employees who need them because of their disabilities, unless doing so would cause undue hardship. In the 25 years it has been revised once in 2008 by The ADA Amendments Act of 2008 (ADAAA). This amendment significantly changed some of the definitions in the original ADA and expanded many of the working parameters employers must deal with in the course of employment. The amendment and changing definitions made it a more difficult law with which to comply. It requires a much more concerted and proactive effort on the part of employers that can be confusing. We will explore the ADA/ADAAA and how employers must deal with the law today.
The purpose of this course is to help the student understand the definitions under the ADA/ADAAA and how they impact the interactions they have with employees. We will explain how the new definitions expand the scope of what a disability is and how employers can manage this process.
